Ordinary Disability
3 cases were reconsidered for Accidental Disability in
light of recent Supreme
Court decision. Two failed to meet criteria for
Accidental Disability. Continued
receiving Ordinary Disability pensions. Third was tabled
for further information.
OTHER BOARD BUSINESSAttorney
General ruled in firefighter case from last month
regarding vote of
Board allowing overage enrollment into PFRS. Board voted
in favor of FF being
able to enroll into system. Vote was 5-3-3. Deputy
Attorney General gave opinion
that, although the vote was a majority of those present,
it was not a majority
of the full 11 members on the Board. After further
review by the AG's office,
it ruled that a majority of the members voting is enough
to pass or defeat
motions.
Firefighter, who was awarded Ordinary Disability in
February 2008, requested
permission to file a new application for Accidental
Disability. Request approved.
Initial application was filed by the city as a
Involuntary Ordinary Disability.
Fire Captain requested to have retirement allowance
based on salary he collected,
in part, as an acting Battalion Chief for 6 months prior
to retirement. This
request was denied as per creditable salary rules in
effect.
Administrative Law Judge upheld Board's decision denying
the right of four
firefighters to purchase time not actually worked.
Board received PFRS experience study report for the
period beginning July
1, 2004 and ending June 30, 2007. This study, done by
the Actuary firm of
Buck Consultants, investigated the mortality and service
experience of PFRS
members and beneficiaries. This study is done every three years.
